By accessing or using TrustMinutes ("the Service"), operated by AgenticTrust LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

TrustMinutes is an AI-powered web application that helps trustees, fiduciaries, and estate planners generate professional trust meeting minutes and fiduciary documentation. The Service provides templates, guided wizards, and export functionality for trust administration documentation.

Important: TrustMinutes is a software tool, not a law firm. We do not provide legal advice. Generated minutes should be reviewed by qualified legal counsel before use.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Billing

TrustMinutes offers both free and paid subscription plans. Paid subscriptions are billed in advance on a monthly basis. You may cancel your subscription at any time through your account settings. All sales are final; however, you may evaluate the Free plan or 14-day free trial before committing.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as detailed in our Privacy Policy. We use bank-level encryption and never sell your data to third parties.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software — are the property of AgenticTrust LLC and are protected by United States and international copyright, trademark, and other intellectual property laws.

7. Limitation of Liability

To the fullest extent permitted by law, AgenticTrust LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes but is not limited to damages for loss of profits, goodwill, data, or other intangible losses.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Utah.
