DMCA Policy

This DMCA Policy describes how TrustMinutes, operated by AgenticTrust LLC, responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. Section 512. We respect the intellectual property rights of others and expect our users to do the same.

1. Reporting Copyright Infringement

If you believe that content available on or through TrustMinutes infringes your copyright, you may submit a written DMCA notice to our designated copyright agent. Your notice must include the following information as required by 17 U.S.C. Section 512(c)(3):

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed. If multiple works are involved, a representative list may be provided.
• Identification of the material that is claimed to be infringing, including the URL or other specific location on TrustMinutes where the material is located.
• Your contact information, including your full name, address, telephone number, and email address.
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

2. How We Respond to DMCA Notices

Upon receiving a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing material. We will notify the user who posted the material that we have removed or disabled access to it. We maintain records of all DMCA notices we receive and our responses to them.

3. Counter-Notice

If you believe that your content was removed from TrustMinutes in error or misidentification, you may submit a written counter-notice to our copyright agent. Your counter-notice must include:

• Your physical or electronic signature.
• Identification of the material that has been removed and the location at which it appeared before it was removed.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your name, address, telephone number, and email address.
• A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for the District of Utah, and that you will accept service of process from the person who provided the original DMCA notice or an agent of that person.

Upon receiving a valid counter-notice, we may restore the removed material within 10 to 14 business days, unless we first receive notice from the copyright owner that they have filed a court action seeking to restrain the alleged infringer from engaging in infringing activity.

4. Repeat Infringers

In accordance with 17 U.S.C. Section 512(i), we will terminate the accounts of users who are determined to be repeat infringers of copyright. We maintain a record of DMCA notices received and take appropriate action against accounts that are the subject of multiple valid infringement notices.

5. Bad-Faith Notices

Under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. We reserve the right to seek damages from parties who submit DMCA notices in bad faith or with knowledge that the claims are false.
